There are some circumstances under which an employer can terminate employment without giving the worker notice
Question: What is the legal procedure to terminate the services of an employee on grounds of poor performance? We have an employee in our Dubai-based (mainland) company, who has not been meeting his targets despite repeated warnings. Please take us through the procedure in terms of visa cancellation, end-of-service benefits, etc.

Response: Pursuant to your queries, it is assumed that you have issued warning notices to your employee in writing. Therefore, the provisions of Federal Decree Law No. 33 of 2021 on the Regulation of Employment Relations (the ‘Employment Law’) and the Cabinet Resolution No.1 of 2022 on the Implementation of Federal Decree Law No. 33 of 2021 Regarding the Regulation of Employment Relations (the ‘Cabinet Resolution No 1 of 2022’) are applicable.

In the UAE, an employee’s obligation is to work diligently. This is in accordance with Article 16(8) of the Employment Law, which states: “The employee shall work diligently and constantly to develop his professional and job skills and improve his performance to the employer." Therefore, if an employee is not performing his work in accordance with the employment contract, an employer may impose disciplinary actions.

This is in accordance with Article 39 (1) (a), (b) & (g) of the Employment Law, which states: “The employer, or his representative, may impose any of the following sanctions on any employee who violates the provisions of this Decree-Law and its Executive Regulations and implementing resolutions:

a. Written attention draw.

b. Written notice (warning).

g. Dismissal with payment of severance pay.”

Further, an employer may dismiss an employee without service of the stipulated notice period on grounds of poor performance once the employee is served with two written warnings upon conclusion of an investigation. This is in accordance with Article 44 (4) of the Employment Law, which states, "An employer may dismiss the employee without prior notice, after a written investigation with him, and dismissal decision shall be in writing an reasoned and given by the employer or his representative to the employee if the employee fails to perform his main duties in accordance with the employment contract and fail to remedy such failure despite a written investigation with him on the matter and two warning that he will be dismissed in case of recidivism."

Further, an employer may not accuse an employee of violation of employment obligations or on grounds of discipline if the same has been detected after 30 days of commission of such disciplinary violations. An employer may also not impose any disciplinary action on an employee after completion of 60 days of disciplinary investigation. This is in accordance with Article 24 (4) of the Cabinet Resolution No. 1 of 2022.

After following the above procedure, an employer may have to pay the employee the pending salary, leave salary entitlements, gratuity and provide with an air ticket prior to cancellation of the work permit with the MOHRE. Once, the MOHRE cancels the work permit as per the procedures mentioned in Article 7(3) of the Cabinet Resolution No. 1 of 2022, an employer may approach the General Directorate of Residency and Foreigners Affairs – Dubai to cancel the residency visa of such employee.

However, if an employer does not follow the aforementioned provisions of law to terminate employment, the employee may file a complaint against the employer with the Ministry of Human Resources and Emiratisation (the ‘MOHRE’) and the termination may be considered as arbitrary in accordance with Article 47 of the Employment Law.

UAE: New law revises legal age for starting business
The age limit for running a business in the UAE has been revised under the new Commercial Transactions Law, according to the Ministry of Economy (MoE).

In a recent media briefing, Abdullah Al Saleh, undersecretary of the MoE, reviewed the new law, which seeks to support and develop the country's business environment.

Among the most prominent features of the new Commercial Transactions Law are:

It reduces the age of legal capacity to practice business to 18 years
The law establishes a legal reference for commercial transactions for banking institutions to stimulate investment and give businesses wider scope for growth and competition
It offers support to Islamic banking in the country and establishes it as one of the main drivers of growth
The law amends the provisions related to the regulation and establishment of financial markets and makes it mandatory to obtain the necessary licenses in accordance with the legislation regulating securities in the country
It offers support to businesses related to the technology sector and commercial activities related to the digital fields
Several senior officials attended the briefing, including Ibrahim Al Zaabi, assistant governor of the Emirates Central Bank for Monetary Policy and Financial Stability; and Dr. Maryam Al Suwaidi, CEO of the Securities and Commodities Authority.

UAE: Can I change the details on Golden Visa to reflect my profession?
Question: I received a Golden Visa in 2022 under my husband's sponsorship. My occupation listed on the Emirates ID is 'housewife'. I recently got a job and a work permit. Should I update my details on the Golden Visa to reflect my profession? If yes, what's the procedure for the same?

Answer: It is assumed that you are employed by a mainland company and as you are a Golden Visa resident of UAE under the sponsorship of your husband, the provisions of Cabinet Resolution No. 1 of 2022 on the Implementation of Federal Decree-Law No. 33 of 2021 Regarding the Regulation of Employment Relations are applicable.

In the UAE, an employer who intends to recruit a golden residency visa holder may obtain a work permit from the Ministry of Human Resources and Emiratisation (MOHRE).

In the UAE, if a wife is sponsored by her husband and she intends to take up employment, then she needs to provide a no objection certificate (NOC) from her husband to her prospective employer to apply for the work permit with MOHRE. This type of permit is used for residents who are sponsored by their families and employed to work in an establishment registered with the Ministry.

Since your residency status in the UAE is ‘housewife’, you may not be able to change the status of your occupation in the UAE Golden Card (resident ID) from ‘housewife’ to the current profession/designation with your prospective employer.

But if you wish to have a UAE golden card (resident ID) with your profession mentioned on it, then you may opt to cancel the existing golden residency visa sponsored by your husband. Thereafter, if your profession meets the requirements to apply for a golden residency visa based on your designation, experience and salary with the prospective employer you may apply for the same, so that the profession under which you obtain a golden residency visa may be mentioned as your occupation on your UAE golden card (resident ID).
