19 years ago, on the 30th of March 2007, Gunditjmara people were granted Native Title for 140,000 hectares of land, rivers, reserves, national parks, creeks and sea.
Gunditjmara Traditional Owner Judy McDonald reflects on this history-making moment.
“I would like to acknowledge the dedication and commitment to our Elders and respected leaders who worked tirelessly for the future of our people.
This work to gain Native Title started back in the 1980s initiated by Damien Bell, who engaged Native Title Research Unit to do research to demonstrate our continual connection to Country.
It took 11 years for the Gunditjmara and the Victorian Government to reach agreement on native title. The Gunditjmara had lodged their native title claim in 1996.
In March 2007, we celebrated the Native Title consent determination. This celebration occurred at the base of Budj Bim with all of our ancestors being represented and followed a special hearing of the Federal Court.
This means we have proved we have maintained a traditional connection to our land and waters in the state of Victoria.
‘In total, native title was recognised across two thousand parcels of vacant Crown land, national parks, reserves, rivers, creeks, and sea, equating to 140000 hectares or 1400 square kilometres in land area. These native title rights and interests are determined as being non-exclusive, that is, they exist on shared country.
The rights are listed as the right to:
• have access to or enter and remain on the land and waters
• camp on the land and waters landward of the high-water mark of the sea
• use and enjoy the land and waters
• take the resources of the land and water, and
• protect places and areas of importance on the land and waters’
Today, on this anniversary, I would like to thank our Elders and respected leaders who were involved for this legacy they have provided for our future, our children, our grandchildren, and our future generations.
More so, I would like to acknowledge our ancestors for never giving up the fight to protect and care for our Country.
