*Passport stamping for UK Nationals resident in Spain*

Many of you who are resident in Spain and protected by the Withdrawal Agreement have contacted us to say that your passport has been stamped on entering or leaving Spain (or both). The most important thing is that this does not affect your residency or rights within Spain and any stamp should be considered null and void when accompanied by a valid residence document.

In March, the European Commission published an amended note on rules for stamping the passports of Withdrawal Agreement beneficiaries, which says: “The Commission considers that there is little practical use in stamping passports of Withdrawal Agreement beneficiaries. Stamping a passport serves to establish whether a non–EU national respected the authorised length of a short stay within the Schengen area, but beneficiaries of the Withdrawal Agreement in a Schengen Member State are not required to leave the Schengen area as they legally reside in one of the Schengen Member State.” You can read the complete note here:https://ec.europa.eu/info/sites/default/files/rules_for_uk_nationals_when_entering_or_leaving_the_schengen_area_for_publication_v2_en.pdf
So, whilst the Commission considers that there is little use in border guards stamping the passports of Withdrawal Agreement beneficiaries, EU law does not prevent them doing so.

⚠️Info on passport validity for UK visitors to Spain⚠️

If you have friends and family from the UK coming to visit you in Spain, do make sure that they are aware of the rules on passport validity. Visitors from the UK must meet the Schengen area rules (https://ec.europa.eu/.../schengen.../schengen-area_en.)

Passports must meet 2 requirements. They must be:
• less than 10 years old on the day you enter (check the ‘date of issue’)
• valid for at least 3 months after the day you plan to leave (check the ‘expiry date’)
People should check both the issue date and the expiry date in their passport. If you renewed your passport early, extra months may have been added to its expiry date. These extra months do not count towards the validity needed and could affect whether your passport meets the requirement for your passport to be less than 10 years old.

**If you are a UK National living in Spain and covered by the Withdrawal Agreement, you do not need any extra months on your passport to enter or exit EU countries - just make sure you carry your TIE card with you and show with your passport at security**

⚠️‼ VERY IMPORTANT - PASSPORTS ‼️⚠️

▪️ Anyone who has got a trip booked to Europe or beyond please check your passport validity. You must check you have enough validity from the date of return, usually 3 to 6 months depending on your destination!

▪️ Any extra months are NO LONGER accepted‼️ Your passport is now ONLY valid, 10 years from the date of issue.

▪️ For example, a passport with an issue date of 1 January 2012 and an expiry date of 31 October 2022 isn’t valid for beyond 1 January 2022, ten years from its original issue.

Guidance from HM Passport Office April 2022

People are being urged not to leave their application for a British passport to the last minute, with demand at an all-time high.
Since April 2021 HM Passport Office has been advising people to allow up to ten weeks when applying for their passport. This remains the case

Due to COVID-19, HM Passport Office saw a significant drop in the number of people applying for passports, with over 5 million people delaying their applications throughout 2020 and 2021.

But with international travel returning to normal, more and more people are applying for a new passport.

People are therefore strongly advised to apply early and help ensure that their holiday plans go smoothly.

Director General of HM Passport Office, Abi Tierney, said:
Now that international travel has resumed, we know people will be looking at going away on holiday and yet many people are leaving applying for a passport too late.
The summer holidays are fast approaching so if you need a new passport, we urge you to apply now.

Our dedicated staff are working tirelessly to ensure that passport applications are processed as quickly as possible.
