Can you come to the US on a tourist visa, get married, and then apply for a green card? The answer might surprise you.

"Yes, it’s possible — but only if you entered the US legally and your spouse is a US citizen."

The big catch? "INTENT"

USCIS will check if you planned the marriage before you entered.

Remember the 30/60/90 Day Rule:

Marry within 30 days → high risk of fraud finding.
31–60 days → gray area.
After 90 days → safer, but not guaranteed."

Your obligation as a co-sponsor (joint sponsor) on Form I-864, Affidavit of Support, ends only when one of the following happens:

✅ Your financial support obligation ends when the sponsored immigrant:
Becomes a U.S. citizen

1. Has worked 40 qualifying quarters (10 years) under the Social Security Act
2. Had passed away or dies
3. Leaves the U.S. permanently (and abandons their green card)
4. Loses lawful permanent resident status through formal deportation/removal

❌ Your obligation does NOT end if:
1. The sponsored immigrant gets divorced from the petitioner
2. You and/or the primary sponsor fall out with the immigrant
3. The immigrant becomes self-supporting or gets a good job
4. You become financially strained or bankrupt

Duration
In most practical cases, the obligation lasts until the immigrant becomes a U.S. citizen or works 40 quarters. That can easily take 10 years or more. There is no automatic expiration just because several years pass.

Can I petition my parents if I am a green card holder / legal permanent in the United States?

The answer is No.

Green card holders (lawful permanent residents) cannot petition their parents to immigrate to the United States.

To petition your parents, you must be a U.S. citizen and at least 21 years old.

What are your options?
If you're a green card holder now and want to petition your parents in the future, here’s what you can do:

✅ 1. Apply for U.S. citizenship
Once you’ve been a green card holder for:

5 years (or 3 years if married to a U.S. citizen),
you can apply for naturalization.

✅ 2. Once you become a U.S. citizen, you can:
File Form I-130 for each parent.

Your parents will be classified as immediate relatives, so there is no waiting line for a visa once approved.

1. Spouse (Husband or Wife)

You can file a Form I-130 (Petition for Alien Relative) for your spouse.
This is part of the F2A category in the family-based preference system.

Your spouse may need to wait for a visa number to become available (check the Visa Bulletin).

2. Unmarried Children (Under 21 Years Old)

This is also in the F2A category.
Children must be unmarried and under 21 at the time of filing.

3. Unmarried Sons and Daughters (Over 21)

These fall into the F2B category.
The wait times are usually longer for this group.

❌ Who You Cannot Petition as a Green Card Holder

1. Parents
You must be a U.S. citizen to petition for your parents.
Green card holders cannot file I-130 petitions for their parents.

2. Married Children
You cannot petition for married children as a green card holder.
Only U.S. citizens can do this.

3. Siblings
Green card holders cannot petition for brothers or sisters.
Only U.S. citizens age 21+ can file for siblings under the F4 category.

What You Can Do in the Future
