🟡Minister António Leitão Amaro defines the increase in the period of residence in Portugal to obtain nationality. The statement was made in response to DN/DN Brasil at a press conference this afternoon, in which the Minister announced the Executive's intention to review the current legislation.
🟡Without explaining for how many years he intends to propose the change, António stated that "the 5-year term and as it stands should be considered in order to strengthen the effectiveness of the connection to the national territory, which is something we consider important", he argued. It was the first time that a member of the Government publicly admitted the intention to change the law.
🟡The minister's view is that the current legislation generates a "call effect", that is, a number of people interested in living in the country due to the ease in obtaining a European document. The current legislation provides for a period of five years of living in the country with a residence permit to apply for Portuguese nationality.
🟡Just over a year ago, Parliament approved a law that now counts these five years from the moment the citizen's application for documentation is approved. This change could reduce the time required to submit a request by up to two years.
🟡However, this law has not been regulated by the current government , which, in private conversations, had already indicated that it did not agree with the five-year period, much less with the reduced count approved by the new law. Some lawyers argue that the law does not need regulation, but at the same time, many immigrants are unable to apply under the new law, because there is no regulation. With today's statement, it is clear that the government will not regulate the law before leaving office - nor after if it is reelected in May.
🟡The changes, if implemented, will directly affect Brazilians living in Portugal who are counting down the time to apply for Portuguese nationality. Currently, the offices of the Institute of Registries and Notaries (IRN) have around 230,000 pending nationality applications , according to a report by DN carried out in February.
🟡With the high number of cases, the waiting time is getting longer. Although the law states that the waiting time is five years, the waiting time is longer, since applications can take up to three years to be completed.
