04 REMARKS CONCERNING THE TRANSFER OF EMPLOYEES TO WORK OUTSIDE THE EMPLOYMENT CONTRACT.

💼 Employers may transfer their employees to work in a manner other than the employment contract where they meet certain conditions under existing regulations.
The basis for moving the employee to another job rather than the employment agreement.
💼 The employer is entitled to temporarily transfer the employee to perform work that differs from the employment contract if:
Dealing with unforeseen difficulties as a result of natural disasters, fires or dangerous epidemics.
💼 They need to take measures to prevent and fight against accidents at work, occupational diseases, electricity and water problems.
💼On account of the production and business needs that the employer may specify in the labour regulations.
💼Employee deployment time.
Maximum 60 working days per year in total.
If the employee is transferred to another position for more than 60 business days in a year, it will not be legal unless the employee consents in writing. If they don't and they have to stop working, the employer has to pay the employee continuously.
💼 Procedures for employee hand-off.
The employer must not only notify the employee at least 03 working days in advance about the transfer, but also clearly inform them about the temporary working term and arrange work suitable to the employee's health and gender.
💼Employee’s Rights
An employee who is transferred to employment other than the employment contract is paid based on the new assignment. The salary for the new job is lower than the salary of the old job, the salary is kept unchanged for 30 working days.
The earnings of the new job must be at least 85% of the earnings of the old job, but not less than the minimum wage.
The employer should be aware of these 4 notes when transferring their employees to work outside the employment contract to avoid conflicts in the use of their own employees.

DON'T OVERSTAY EVEN 1 DAY!
THE CONSEQUENCES OF LETTING YOUR VISA EXPIRES
If your visa has expired when you are in Vietnam, your residence in Vietnam is deemed illegal. You are not allowed to exit or keep on staying in Vietnam. The only thing you can do in this case is a detailed notification about your status to the Immigration Department; pay a fine prior to leaving Vietnam.
The maximum fine level of the violation of letting your visa expires is VND 40.000.000. Depending on the seriousness of violation, a fine is divided into 3 levels:
- Your visa is expired 15 days or less without any aggravating circumstances: VND 1.250.000.
- Your visa is expired more than 15 days: VND 4.000.000.
- If your case is the most serious as prescribed (the expiration of a long time): VND 30.000.000 – VND 40.000.000.
If you have an aggravating circumstance, the maximum fine would be imposed. In addition to that, you may be sanctioned in the form of expulsion from Vietnam. Your file will be served in the blacklist that would be difficult for you to enter Vietnam in the future.

NOTICE ABOUT “AUTOMATIC STAY EXTENSION”
1. Foreigners who entered Vietnam on visa waivers, e-visas or tourist visas from March 1st, 2020 are entitled to automatic stay extension until April 30st, 2021 and can depart from Vietnam without having apply for stay extension. For those who entered Vietnam before March 1st, 2020, the same automatic stay extension until April 30st, 2021 can be considered, subject to provision of proof that the person was stranded in Vietnam due to Covid-19, accompanied by a diplomatic Note (with Vietnamese translation) from relevant diplomatic missions, or a written document from relevant Vietnamese authorities confirming that the person was required to undergo mandatory quarantine or treatment for Covid-19, or advice of other force majeure. The person is required to present the diplomatic Note or written document on departure from Vietnam.

2. During “automatic stay extension” period, foreigners are required to complete temporary residence and health status declaration.

3. Foreigners who are not subject to Paragraph 1 or violate Vietnamese laws will be treated according to applicable laws of Vietnam.
