*Oct 17th 2023 : Sharing H1B to F1 visa interview experience (due to H1B petition revocation/NOIR/NOID by USCIS due to multiple H1B filings by employer), Interview location : Guadalajara, same day passport*

*This is one of crucial case among recent times*
Note : We are sharing this info for knowledge purposes :
We have observed that uscis started looking at data from year 2022 H1B filings etc., and trying to find petitions that were filed multiple times by employers to improve chances for H1B pickup in lottery
Based on clients who reached out for some help due to H1B revocation by USCIS,

There are 2 cases & 2 solutions explained based on F1 visa stamping is still valid or expired

1) Need for H1B to F1 visa stamping (as previous F1 visa stamping is expired (or) H1B stamping still valid in passport and need to move to F1 by visa stamping to continue their education on F1

2)Need sevis activation for F1 related i-20 at US Mexico border by crossing out of USA to Mexico & coming back to USA to continue on F1 & education (If previous F1 visa was still valid) due to last year H1B approval petition got revoked due to multiple H1B filings by employer.

Please share any tips you think will useful for getting emergency appointments (or) non-emergency appointments? Randomly need to check dates; i got it 2 days before and prepared everything in 1 day and fly. I already aplied Mexico visa also.

*Oct 11th 2023 : Sharing details of H1B visa renewal at Guadalajara Mexico (With I-797B petition & without i-94)*
*I-797B is a consular processing petition approved by USCIS that mandates applicant to step out of country and finish stamping and can continue work in USA*

More info about I-797B (consular processing) :
I-797B, this means that the petition is approved, but the COS/Extension of Stay(i-94 is not given) is not approved.

✅I-797A comes with i-94 attached to it, so you can continue your stay in USA & whenever you leave USA, you can finish stamping & enter back into USA.
✅I-797B does not come with i-94 attached, that mandates you to step out of USA & finish stamping if your H1B stamping is expired, If your H1B stamping is still valid, you can simply go to US Mexico border & get i-94 extended (or) Simply fly to Mexico (Using US Visa, no need of mexican visa if you have valid US visa) & get i-94 extended, come back to USA & can continue your work.

*Different scenarios where someone will get i-797B from uscis are*
1) If employer filed extension petition late *after i-94 Expiry (to fix the issue of overstay or to avoid RFE, Employer/Attorneys file consular processing)
2) Employer prefers to file under consular processing if there are any underlying issues such as amendment not filed on-time, to rectify any underlying immigration issues, so petition gets approved (instead of getting RFE)

Note :
✅By default, Attorney's file consular petitions with home country as default consulate location, but you can still attend visa interview at any other consulate that allows visa stamping (not mandatory to just only attend visa interview at home country)
✅ No need to file i-824 petition as well if you are attending visa interview at consulate other than what is listed in your i-797B petition

Total time in and out was around 35-45 minutes. There were at least 50 people ahead of me. They asked me if I was alone or with a group/family. I said I am alone. I also mentioned that I don't know Spanish at all and only speak English and am a physician in United States. They took me to a seperate line where I just had one person ahead of me. Officer was pleasant and got done pretty quickly.

I requested for early passport pickup because I have to join back work for my ICU duties on Sept 25 Monday to take care of my patients. The officer said that the visa is approved but needs clearance before sending out the passport. She said most likely clearance should come before 2 PM next day and I can pick up between 2-2:30 PM next day. Also said that in case it doesn't come then I will have to wait 2-3 business days to pick it up. The officer handed me an orange ticket with tomorrow's Date ( Sept 22)

Emergency request at Tijuana got denied. Fortunate to get non-emergency appointments at short notice.

Please share any tips you think will useful for getting emergency appointments (or) non-emergency appointments?
Check appointments everyday (once morning and evening). If you check more frequently the website stops opening and you need to wait for at least half a day to pass to be able to login again.

Tijuana was not giving any emergency appointments even for healthcare / doctors based on emergency appointment requests that got denied from last Friday (Aug25th) & Monday (Aug28th)

It's better to skip applying emergency appointment at Tijuana for now,
If you get any non-emergency appointments there, you can book and attend without any issues

From last 2 to 3 years, Tijuana served alot of doctors and Healthcare professionals for their visa stamping through Emergency appointments

Seems they want to take a break &
clear pending local B1/B2 visa applicants 1st as per their response email

Please apply for Emergency appointment at Mexico city or Nuevo laredo or Monterrey if you are doctor/ Healthcare
