ملخص
صدر القانون رقم (23) لسنة 2010م بشأن العلامات التجارية والمؤشرات الجغرافية في 21 نوفمبر 2010، كما صدرت اللائحة التنفيذية الخاصة به في 03 أكتوبر 2011، حيث تضمن القانون واللائحة التنفيذية العديد من المواد ذكر فيها شروط تسجيل العلامات التجارية وآلية التسجيل والإجراءات المتبعة لتسجيل العلامات التجارية وآثار التسجيل التي يحصل عليها مالك علامة تجارية، كما تضمن إجراءات التجديد ونقل الملكية والترخيص والشطب والبطلان، والعقوبات الخاصة بالتعدي على حقوق الآخرين.
تتبع اليمن التصنيف الدولي للبضائع والخدمات لغايات تسجيل العلامات التجارية بموجب اتفاقية نيس (النسخة الثامنة)، ولا يمكن في اليمن تسجيل العلامات التجارية لحماية المشروبات الكحولية، ويجب تقديم طلب منفصل بالنسبة لكل فئة دولية من البضائع أو الخدمات كما يجب تقديم كافة الوثائق مع طلب التسجيل، كما أصدرت الإدارة العامة لحماية الملكية الفكرية مؤخراً قرار يقضي بعدم إمكانية إيداع العلامات التجارية على ترويسة الفئات الدولية.
حال إيداع طلب تسجيل العلامة التجارية لدى مكتب العلامات التجارية في الإدارة العامة لحماية الملكية الفكرية، يتم فحص الطلب للتأكد من قابلية العلامة للتسجيل، في حال قبول الطلب، يتم تحويل الطلب للنشر في مجلة التجارة التي تصدرها وزارة الصناعة والتجارة، ويمكن لأي جهة ذات مصلحة التقدم باعتراض على تسجيل العلامات التجارية خلال مدة تسعون يوماً من تاريخ نشر الطلب، يحال الإعتراض إلى المحكمة في حال عدم تسويته من قبل المسجل، أو في حال اعتراض أي من الطرفين على قرار المسجل، وفي حال رفض الاعتراض أو عدم ورود إعتراض خلال الفترة القانونية، يتم تسجيل العلامة التجارية ومنح مالكها شهادة تسجيل بذلك.
إن المدة القانونية لحماية العلامات التجارية هي 10 سنوات تبدأ من تاريخ إيداع طلب التسجيل، وهي قابلة للتجديد كل 10 سنوات، مع ضرورة تقديم طلب التجديد خلال السنة الأخيرة من مدة الحماية، كما ينص قانون العلامات التجارية على إمكانية تقديم التجديد خلال سنة إعتباراً من تاريخ إنتهاء فترة الحماية القانونية بدون فرض أي غرامات.
كما تضمن القانون ضرورة أن يتم قيد التعديلات التي قد تطـرأ على العلامات التجارية أو مالكها كتعديل أسم المالك، أو تعديل عنوان المالك، أو تحديد المنتجات المسجلة ضمن العلامات، أو نقل ملكية العلامات حال بلوغ العلامات مرحلة التسجيل، حيث تنشر هذه التعديلات في مجلة التجارة التي تصدرها وزارة الصناعة والتجارة ويصدر فيها إشعار من قبل الإدارة العامة لحماية الملكية الفكرية.
إن استعمال العلامة التجارية في اليمن ليس إلزاميا لغايات التقدم بطلب التسجيل أو لغايات إدامة نفاذه، إلا أن العلامة تكون عرضة للشطب بناء على طلب أي شخص ذي مصلحة إذا أثبت عدم استعمال العلامة التجارية خلال خمس سنوات متتالية على الأقل، أو في حال عدم وجود استعمال بحسن نية للعلامة التجارية على البضائع التي سجلت العلامة لحمايتها، ومن الجدير بالذكر بأن حقوق العلامة التجارية الممنوحة في اليمن من خلال التسجيل تعتبر قطعية في حال استعمال مالكها لها لمدة خمس سنوات متتالية.
يعتبر الاستعمال غير المصرح به لعلامة مسجلة بموجب القانون، وتقليد العلامة ووضعها على البضائع أو استخدامها بالنسبة للخدمات في نفس الصنف، وبيع البضائع التي تحمل علامة مزورة أو حيازتها بقصد البيع أو عرضها للبيع أو استعمال علامة مسجلة أصولا من قبل شخص آخر خلاف المالك بقصد الترويج غير المصرح به لبضائع أو خدمات في نفس الصنف جرائم يعاقب عليها القانون.

Law No. (23) of 2010 on trademarks and geographical indicators was issued on November 21, 2010, and its executive regulations were issued on October 3, 2011, where the law and regulations contained many articles stating the conditions of trademark registration, registration mechanism and procedures. Trademark registration and registration effects obtained by a trademark owner, as well as renewal, transfer, transfer of ownership, licensing, write-off, nullity, and penalties for infringement of the rights of others.
Yemen follows the International Classification of Goods and Services for trademark registration purposes under the Nice Convention (8th edition), trademarks cannot be registered in Yemen for the protection of alcoholic beverages, and a separate application must be made for each international category of goods or services and all must be submitted. Documents with the application for registration, and the General Directorate for intellectual property protection recently issued a decision that trademarks cannot be deposited on the international category banner.
Once the trademark registration application is filed with the Trademark Office of the General Directorate for Intellectual Property Protection, the application is examined to ensure that the mark is registerable, if the application is accepted, the application will be forwarded for publication in the Trade Journal issued.This is the Ministry of Industry and Trade, and any interested party can lodge an objection to the registration of trademarks within a period of 90 days from the date of publication of the application, the objection shall be referred to the court if it is not settled by the registrar, or if either party objects to the decision of the registrar, and if the objection is rejected or not received An objection during the legal period, the trademark is registered and the owner is granted a registration certificate.
The legal period for trademark protection is 10 years from the date of filing a registration application, and is renewable every 10 years, with the renewal request required during the last year of the protection period, and the Trademark Act stipulates that the renewal can be submitted within one year as of the date of the date of the renewal. The legal protection period expires without imposing any fines.
The law also stipulates that amendments that may be made to trademarks or their owner, such as modifying the owner's name, modifying the owner's address, identifying products marked under the marks, or transferring ownership of trademarks upon the registration stage, must be recorded, as these amendments are published in the Trade Journal. The unauthorized use of a trademark registered by law, imitating the mark and placing it on the goods or its use for services in the same category, and the sale or possession of goods with a false mark with intent to sell or offer it for sale or the use of a registered mark is considered to be the assets of a person other than the owner with intent Unauthorized promotion of goods or services in the same category is punishable by law.
