Ministry of Tourism legal requirements for sector operators.

There are things we sometimes or many times take for granted thinking that we all know. But just in case you did not know the legal requirements to run some of these businesses under the tourism industry, here is a quick reminder: following the enactment of the Tourism and Hospitality Act No. 13 of 2015, the Ministry transferred the functions of licensing, standards, classification and grading from the Department of Tourism to Zambia Tourism Agency, a Statutory Body under the Ministry.
All tourism enterprises ought to take note.
All tourism enterprise licenses are valid for 3 years. Pay tourism enterprise online via GSB to Zambia Tourism Agency or contact them for any clarifications.
The term "tourism enterprise" includes the following:
An accommodation establishment, tour operation business, travel agent, amusement or theme park, air charters and gliding business, water sport, a vehicle or a vessel leasing business (car rentals/hire), a house boat, a hunting safari, wilderness walks, camping, back-packing, mountain climbing, sight seeing, tour guide or travel service, tour guide rescues, a restaurant, a discotheque (night club), a convention/conference centre, an enterprise or person catering for tourists or events or providing outside catering services, an exhibition or any other business activity declared by the Minister by Statutory Instrument.
Please note that payment of license fees is a legal requirement and non or late payment of license fees within the stipulated period attracts a fine not exceeding 100,000 penalty units as provided for in the Tourism and Hospitality Act No. 13 of 2015 section 24 (5).
Other requirements:
If you are operating an accommodation establishment exceeding 10 rooms you are required to pay Hotel Managers Practicing license (K2,250) one off payment and renew it yearly for K1,050. Those operating less than 10 rooms you can apply for Exemption Certificate (K1 050) which you also renew yearly (K1,050).
There penalties for late or non payment of these statutory fees so make these payments with patriotism.
Also note that the Ministry of Tourism in collaboration with the Ministry of Finance introduced Tourism Levy on 1st March, 2017. This levy is a charge pegged at 1.5% of a person's total bill in respect of accommodation amd events applicable to both local and international consumers of tourism facilities as enshrined in the Tourism and Hospitality Act No. 13 of 2015, National Tourism Policy 2015 amd implemented through Statutory Instruments No. 56 and 69 of 2016 as well as a Statutory Instrument No. 35 of 2017. All persons providing tourism services are obliged to charge tourism levy to any nearby ZRA by every 14th day of subsequent month.
Tourism Levy is a Government of Zambia's initiative aimed at increasing financial support to the Tourism Development Fund (TDF) for product development, tourism research, tourism marketing, tourism training and infrastructure development.
