While there’s no shortage of trendy vacation ideas for 2025, Australia remains a destination of choice for travellers the world over.

The Government has 𝐍𝐎𝐓 announced the 2025–26 permanent Migration Program planning levels in this evening Budget papers.
Here are some key points from the Federal Budget:
Migration Program Planning: The 2025-26 permanent Migration Program sets a planning level of 185,000 places, with 71% allocated to the Skill stream and 28% to the Family stream, totaling 132,200 places.
The closure of the Business Innovation and Investment Program (BIIP) visa category effective from July 2024 has not changed. New applications for the Business Innovation and Investment (Provisional) (subclass 188) visa remain halted.
We have consistently emphasized the proactive approach of promoting subclasses 190 and 491, aligning with clients’ points in the Expression of Interest (EOI) system. The budgetary figures validate our strategy.
𝐂𝐨𝐧𝐜𝐥𝐮𝐬𝐢𝐨𝐧
The consistent permanent migration level has a strong focus on the Skill stream, indicating strong support for businesses needing skilled labor.
Overall, we don’t see any significant drastic change or setback for Skilled migrants. The steady planning level ensures continued opportunities for permanent residency, particularly for those with skills in demand. Yes, the reduction in the Skilled Independent category (Subclass 189) means potential migrants might need to consider other subclasses like 190 and 491, as we have been advocating all this while!
Its is not expected that 482 and 494 visa holders who have stopped working for their sponsor and have lodged a nomination application to change employers within the required timeframes (180 day since ceasing employment with their previous sponsor) to cease working for their prospective sponsor, even if the Condition 8607(5) and 8608(5) timeframes have lapsed.
Therefore, Sc 482 and Sc 494 visa holders will no longer be disadvantaged by processing delays of nomination transfers as they will continue to have work rights, ensuring they can support themselves while awaiting the outcome of their nomination application.

The Department's website has been updated with the number of nominations made by State and Territory governments for Sc 190 and Sc 491 for the month of January. Specifically, the invitations in the attached photo were between 31 December 2024 and 31 January 2025.

Congratulations to our client Mrs Nguyen on the waiver of her 8503 Condition.
Mrs Nguyen arrived to Australia on a tourist visa with condition 8503. This condition prohibits applicants from applying for a further substantive onshore visa (other than a protection visa). After developing a relationship with her Australian partner, Mrs Nguyen presented to our office in order to apply for an onshore partner visa.
An application for a waiver of 8503 was made on the 29 June 2022 which was denied by the Department of Home Affairs. We then sought appeal of this decision at the Federal Court of Australia and after three long years we finally won the appeal and today the waiver was granted.
This means that our client is allowed to stay in Australia with her family whilst she awaits the outcome of the partner visa. Keeping families together is our main objective.

NSW Business and Skilled Migration has announced that they are no longer accepting applications for Subclass 491 Skilled Work Regional visas under Pathway 1, as the allocation for the 2024-25 program year has been reached.
All applications that have already been submitted will be processed. However, due to the high volume of applications, processing times may exceed the usual 6-week estimate.
𝑰𝒏𝒗𝒊𝒕𝒂𝒕𝒊𝒐𝒏 𝒇𝒐𝒓 𝑺𝒖𝒃𝒄𝒍𝒂𝒔𝒔 491 𝑷𝒂𝒕𝒉𝒘𝒂𝒚 2
Invitations for Subclass 491 Pathway 2 have now commenced. The first round of invitations was conducted yesterday, with additional rounds scheduled every 4 weeks until the NSW allocation is filled.

The Northern Territory Government has received sufficient nomination applications to fill the total allocations for the 2024-25 program year. To manage the large number of applications received with the number of nominations allocation to the Northern Territory for the 2024-25 program year, it has suspended its online portal for new applications.
All applications received before the suspension will continue to be assessed, and those who meet the eligibility criteria will be issued nominations.
The program will be reopened for new applications once nomination allocations are received for the 2025-26 program year.
During the suspension, applications will continue to be accepted by exception for onshore applicants who have the following visa deadlines before 1 July 2025:
*Those who have visas expiring before 1 July 2025 and not eligible for a Temporary Graduate Visa
*Those who are due to become ineligible for the GSM program due to attaining a certain age before 1 July 2025 (e.g. turning 45 or losing points for age, bringing the total migration points to below 65).

On 3 December 2024, the Australian Government announced the release of the Core Skills Occupation List (CSOL).
The new CSOL fulfils the Government’s commitment to replace complex, out of date and inflexible occupation lists in our temporary skilled visa program. The CSOL is a single consolidated list, informed by labour market analysis and stakeholder consultations by Jobs and Skills Australia (JSA) that provides access to temporary skilled migration for 456 occupations.
The CSOL will apply to the Core Skills stream of the new Skills in Demand visa, which will replace the Temporary Skill Shortage (subclass 482) visa on 7 December 2024. The CSOL will also apply to the Direct Entry stream of the permanent Employer Nomination Scheme (subclass 186) visa.
More details on other reform taking place on 7 December 2024, including the Skills in Demand visa and National Innovation visa, will be announced shortly.
The Victorian State Government have announced that for the remainder of the 2024-25 skilled visa nomination program, the following construction trade occupations are recognized as priortity occupations under the Skilled Work Regional (Sc 491) visa and Skilled Nominated visa (Sc 190) visa:
