Viele kennen Brasilien vor allem als Urlaubsziel. Weniger bekannt ist der Süden des Landes. Dort findet man eine hohe Lebensqualität, eine gute Infrastruktur, viel Natur und eine lange deutschsprachige Tradition. Mehrere Millionen Menschen haben deutsche Wurzeln, und in vielen Orten werden bis heute Deutsch oder deutsche Dialekte gesprochen.

Kürzlich haben die Festnahmen von drei südamerikanischen Staatsbürgern in Brasilien wegen rassistischer Handlungen und Äußerungen intensive Diskussionen in den sozialen Medien ausgelöst. Während einige strengere Gesetze gegen Diskriminierung in ihren eigenen Ländern fordern, halten andere die Maßnahmen der brasilianischen Behörden in solchen Fällen für überzogen.
Was viele Ausländer — einschließlich Bürger benachbarter Länder — nicht wissen: Die brasilianischen Gesetze im Bereich Diskriminierung wurden in den letzten Jahren deutlich verschärft.

In Brasilien beginnen viele Ausländer romantische Beziehungen, ohne sich darüber im Klaren zu sein, dass bestimmte Umstände selbst ohne formelle Eheschließung erhebliche rechtliche Konsequenzen nach sich ziehen können. Kulturelle Unterschiede, gesellschaftliche Gewohnheiten und mangelnde Kenntnis der lokalen Gesetzgebung führen häufig zu der irrigen Annahme, dass ausschließlich die standesamtliche Ehe vermögensrechtliche oder familienrechtliche Verpflichtungen begründet.

Das brasilianische Recht legt den Begriff der familiären Gemeinschaft jedoch weit aus, insbesondere im Zusammenhang mit der sogenannten eheähnlichen Lebensgemeinschaft („união estável“).Nach brasilianischem Gesetz und gefestigter Rechtsprechung kann eine eheähnliche Lebensgemeinschaft anerkannt werden, wenn eine öffentliche, kontinuierliche und auf Dauer angelegte Beziehung mit dem Willen zur Gründung einer familiären Gemeinschaft besteht. Für ihre Anerkennung ist keine gesetzliche Mindestdauer vorgesehen. Daher kann selbst dann, wenn die Parteien ihre Beziehung lediglich als „Dating“ oder „Partnerschaft“ bezeichnen, im Rahmen einer gerichtlichen Prüfung die tatsächliche Lebenswirklichkeit entscheidend sein.

Für viele Ausländer werden Umstände, die kulturell lediglich als romantische Beziehung verstanden werden, in Brasilien unter Umständen als Indizien für das Bestehen einer eheähnlichen Lebensgemeinschaft gewertet, insbesondere wenn folgende Elemente vorliegen: gemeinsamer Haushalt; regelmäßige gemeinsame Tragung von Kosten und Ausgaben;öffentliches Auftreten als familiäre Einheit; wirtschaftliche Abhängigkeit; gemeinsame Vermögens- oder Finanzplanung; erhebliche Beteiligung am häuslichen Alltag;gefestigte familiäre Lebensführung. Die gerichtliche Anerkennung einer eheähnlichen Lebensgemeinschaft kann erhebliche rechtliche Folgen haben, darunter:die Aufteilung von Vermögenswerten, die während des Zusammenlebens entgeltlich erworben wurden; die Möglichkeit von Unterhaltsansprüchen zwischen ehemaligen Partnern, abhängig von den konkreten Umständen des Einzelfalls;erbrechtliche Ansprüche;sozialversicherungs- und vermögensrechtliche Auswirkungen.Sofern keine anderslautende schriftliche Vereinbarung besteht, gilt grundsätzlich der Güterstand der teilweisen Gütergemeinschaft („comunhão parcial de bens“), wonach während des Zusammenlebens entgeltlich erworbene Vermögenswerte Gegenstand einer Vermögensaufteilung sein können.Ein weiterer bedeutender Aspekt des brasilianischen Familienrechts ist die rechtliche Anerkennung sozial-affektiver Elternschaft („parentalidade socioafetiva“). Aus diesem Grund erfordern langfristige Beziehungen — insbesondere solche mit gemeinsamem Wohnsitz — eine sorgfältige rechtliche Vorsorge. Ein häufig genutztes präventives Instrument ist der sogenannte Dating-Vertrag („contrato de namoro“), ein Dokument, mit dem ausdrücklich festgehalten wird, dass die Parteien eine romantische Beziehung führen, jedoch derzeit nicht die unmittelbare Absicht haben, eine familiäre Gemeinschaft im rechtlichen Sinne zu begründen. Neben vermögensrechtlichen Fragen können Ehe und eheähnliche Lebensgemeinschaften mit brasilianischen Staatsangehörigen auch migrationsrechtliche Auswirkungen gegenüber der Brasilianische Bundespolizei entfalten, insbesondere im Zusammenhang mit Aufenthaltserlaubnissen auf Grundlage familiärer Bindungen.

Vor diesem Hintergrund wird Ausländern dringend empfohlen, nicht nur vor einer Eheschließung, sondern auch vor oder während langfristiger Beziehungen in Brasilien präventive rechtliche Beratung durch einen auf Familienrecht spezialisierten Rechtsanwalt in Anspruch zu nehmen. DATING IN BRAZIL: WHAT FOREIGNERS NEED TO KNOW

In Brazil, many foreigners enter into romantic relationships without realizing that certain situations may give rise to significant legal consequences, even in the absence of a formal marriage. Cultural differences, social customs, and unfamiliarity with local legislation often create the mistaken assumption that only civil marriage establishes financial or family-related obligations. Under Brazilian law, however, the concept of a family entity is interpreted broadly, particularly in relation to stable unions (“união estável”).

Under Brazilian legislation and case law, a stable union may be recognized where there is a public, continuous, and lasting relationship established with the intention of forming a family unit. There is no minimum statutory period required for such recognition. Consequently, even where the parties describe the relationship merely as “dating”, the practical reality of the relationship may prevail in the event of judicial scrutiny.

For many foreigners, circumstances culturally perceived as a simple romantic relationship may, in Brazil, be interpreted as evidence of a stable union, particularly where there is:

cohabitation;

regular sharing of expenses;

public presentation as a family unit;

financial dependency;

joint financial or property planning;

significant participation in domestic life;

an established family routine.

Judicial recognition of a stable union may give rise to important legal consequences, including:

division of assets acquired for value (onerous acquisition) during the relationship;

the possibility of partner maintenance claims between former partners, depending on the specific circumstances of the case;

inheritance rights;

pension and property-related implications.

In the absence of a written agreement establishing otherwise, the default property regime generally applicable is the partial community property regime, under which assets acquired for value during the relationship may be subject to division.

Another particularly relevant aspect of Brazilian Family Law is the legal recognition of socio-affective parenthood. In certain circumstances, emotional and parental bonds developed within a family environment may contribute to judicial discussions regarding socio-affective parental relationships, provided there is evidence of the continuous and voluntary exercise of parental functions. This is a highly sensitive area of law and always dependent on the specific facts and evidence of each case.

For this reason, long-term relationships — particularly those involving cohabitation — require careful legal planning. One commonly used preventive instrument is the dating agreement (“contrato de namoro”), a document intended to formally record that the parties are involved in a romantic relationship without the immediate intention of establishing a family entity.

Although a dating agreement may constitute important evidence regarding the parties’ intentions, it does not automatically prevent a court from recognizing a stable union if the factual circumstances demonstrate the legal requirements for such recognition.

Particular caution is also recommended where there is:

a substantial disparity in assets between the parties;

international assets or cross-border wealth structures;

succession or inheritance concerns;

children from previous relationships;

immigration-related matters;

joint investments;

real estate acquisitions.

In addition to property-related matters, marriage and stable unions involving Brazilian nationals may also produce immigration consequences before the Federal Police of Brazil, including residence applications based on family ties.

In light of the above, foreigners are strongly advised to seek preventive legal guidance from a lawyer specialized in Family Law not only prior to marriage, but also before or during long-term relationships in Brazil. Proper legal advice allows individuals to understand the potential legal consequences of cohabitation, clarify the parties’ rights and obligations, structure preventive agreements, and minimize the risk of future disputes arising from differing interpretations regarding the nature of the relationship.
