The way you communicate and the way you make payments can determine whether your process stays manageable or turns into years of litigation. Below are two essential checklists every foreign father should keep in mind.
📱 Do’s and Don’ts for Communication During Custody Disputes
Do’s
✅ Keep messages short and neutral – stick to facts, avoid emotional tone.
✅ Record voice calls when possible to preserve accurate evidence.
✅ Communicate through official channels (notary, ICBF, Comisaría de Familia) whenever possible.
✅ Document expenses and payments to show your support is consistent.
✅ Save all communications in case you need to defend yourself legally.
Don’ts
❌ Don’t argue over WhatsApp or text—these messages are often used as evidence.
❌ Don’t send emotional or impulsive replies—what feels like self-defense can be labeled as aggression.
❌ Don’t threaten to withhold support—it can be classified as economic violence.
❌ Don’t assume “small arguments” are harmless—accusations can escalate into Comisaría and Fiscalía processes lasting years.
⚠️ Reminder: In Colombia, psychological and economic violence are criminal offenses, even without physical violence. Always write and speak as if your words could appear in court.

Do’s
✅ Pay through traceable methods (bank transfer, direct deposit) — always leave a paper trail.
✅ Request official receipts or signed acknowledgments of payments.
✅ Pay third parties directly (schools, transportation, cafeterias, health insurance) to ensure funds go to the child.
✅ Keep copies of all payments and invoices for your legal defense if needed.
✅ Stay within the legal cap — child support cannot exceed 50% of your monthly income, and courts must leave you enough for essentials.
Don’ts
❌ Don’t give cash without receipts — it can be denied later.
❌ Don’t agree to pay beyond your real capacity out of guilt or pressure.
❌ Don’t stop paying suddenly — always request a formal modification if your income changes.
❌ Don’t forget the minimum wage presumption — if unemployed, the law assumes you earn at least minimum wage.
❌ Don’t rely on verbal agreements — they hold little weight in legal disputes.
⚠️ Reminder: Child support in Colombia is about fair sharing of responsibility. Judges weigh income, essential living expenses, and even the socioeconomic background (estrato) of the Colombian parent when setting payments.
