Under the UK’s new immigration policy introduced in 2025, the qualifying period for Indefinite Leave to Remain (ILR) has been extended from five to ten years for most migrants. However, transitional arrangements have been implemented to accommodate certain existing Skilled Worker visa holders. 
Transitional Arrangements for Existing Skilled Worker Visa Holders:
• Eligibility Criteria: If your Certificate of Sponsorship (CoS) for the Skilled Worker visa was assigned before 4 April 2024, and you have continuously held permission as a Skilled Worker since that time, you remain eligible to apply for ILR after five years of continuous residence in the UK. 
• Continuity of Permission: It’s crucial that there has been no break in your Skilled Worker visa status. If you’ve changed employers, the transitional arrangements still apply, provided there was no interruption in your visa coverage. 
• Application Deadline: These transitional provisions are set to remain in effect until 3 April 2030, allowing eligible individuals to apply for ILR under the five-year route within this timeframe. 
Implications:
If you meet the above criteria, you can proceed with your ILR application after five years of continuous residence under the Skilled Worker route. However, if your CoS was assigned on or after 4 April 2024, or if there has been a break in your Skilled Worker visa status, the new ten-year residency requirement will apply to your ILR application.
