Before the law, everyone is equal. If a person is taken into custody by the police in any case, certain fundamental rights are guaranteed to protect them. Being aware of these rights can help you safeguard yourself legally.
✅ 1. Right to Know the Grounds of Arrest (Article 22(1))
You have the right to be informed of the reason for your arrest. The police must prepare an Arrest Memo, clearly stating the date, time, and grounds of arrest.
✅ 2. Right to Remain Silent (Article 20(3))
You are not obligated to answer every question during interrogation. You have the right to remain silent, especially when answering may incriminate you (self-incrimination).
✅ 3. Right to Be Produced Before a Magistrate Within 24 Hours (Section 58 BNSS)
After arrest, the police must present you before the nearest Magistrate within 24 hours (excluding travel time). Detaining you beyond this period is unlawful.
✅ 4. Right to Medical Examination (Section 53/54 CrPC – Now BNSS)
You have the right to request a medical examination to document any injuries. This serves as a safeguard against custodial torture and ensures your physical well-being is recorded.
✅ 5. Right to Free Legal Aid (Article 39A)
If you are unable to afford a lawyer, the State is obligated to provide free legal assistance to ensure fair representation and justice.
