I saw this affidavit on Late Miss Habila's Episode, the physiotherapist seconded to Mr. Umahi, our Honourable Minister.
For anyone that cares to know, a Crime even when committed against an individual, is a State offence and an individual cannot in Law, refuse to progress with the matter once instituted, as a matter of Law, the Victim is only but a witness in his own Case.
Only the Prosecution can withdraw on grounds founded in Law, not as a wish of the victim or relatives, as a matter of Law, if the Family refuses to cooperate and give information to the prosecution or police to assist in investigation or prosecution, if they refuse to disclose facts to the investigation agencies or prosecution they would have committed a Crime and can also be prosecuted and imprisoned, if found Guilty.
the Back principle of the generality of Criminal Law(s) is that the Society be cleansed of Criminals, to protect the non-crominals, to protect the Society and all that it comprises, including infrastructures and amenities.
So, it is on this principle that every Criminal offence and prosecution takes Life from, it can therefore not be heard that a Victim, relatives and/or Well wishers withdrew a Criminal Case or refused to cooperate with officers of the Law or Lawyers during investigation and prosecution.
it may be strangely Popular but it is unknown to our Laws.
