What you should know about the asylum system in Canada

Canada’s asylum system exists to protect people who are fleeing persecution, violence, or a risk to their life or safety in their home country. In recent years, Canada has seen a steady rise in the number of asylum claims received. This increase is driven by multiple factors, including:

✓Global instability.
✓Armed conflict.
✓The growing number of people displaced worldwide.

The obligation of Canada

1. Under the Immigration and Refugee Protection Act, Canada has an obligation to assess the eligibility of asylum claims made by individuals who arrive in the country seeking refugee protection (asylum). Claims are first assessed for eligibility to be referred to the Immigration and Refugee Board of Canada (IRB). All eligible claims are determined by the IRB based on the evidence and arguments presented, and in line with Canadian laws.

2. Asylum claimants must prove that they have a well-founded fear of persecution or face a risk of serious harm such as torture, cruel and unusual treatment, or punishment in the country where they are a citizen or where they have nationality. If they are stateless, this applies to the country where they usually live.

3. Those whose claims are accepted become protected persons and may apply for permanent residence under the protected persons in Canada category. Those whose claims are denied may be subject to removal from Canada.

For the Individual Worker (after the LMIA is approved):

Receive the LMIA: The employer in Canada must provide you with a copy of the approved LMIA or the LMIA decision number.

Verify your qualifications: Ensure you meet the specific education, work experience, and language requirements mentioned in the LMIA application.

Apply for a work permit: With the approved LMIA, you can then apply for your work permit from IRCC.

Important Considerations

The employer's responsibility: The employer is the one responsible for the LMIA process; they cannot make you pay for it.

Understanding LMAI & Canadian Work Permits (part 1)

What is LMAI?
LMAI is an acronym for Labour Market Impact Assessment. It is a document that your employer in Canada must obtain to prove there's a need for your position and no available Canadian workers.

You, as the individual worker, will need a copy of this approved LMIA from the employer to apply for your own work permit from Immigration, Refugees, and Citizenship Canada (IRCC).

What the employer does

The employer in Canada applies for the LMIA by submitting an application, supporting documents, and paying the fee through the Labour Market Impact Assessment (LMIA) Online Portal.

Here's a breakdown of the process for both the employer and the individual:
1. For the Employer (to obtain the LMIA):

Create a Job Bank account: The employer needs a Job Bank for employers account to access the LMIA Online Portal.

Submit the application: The employer must create and submit the LMIA application online through the LMIA Online Portal, providing details about the job offer and business.

Provide supporting documents: The employer needs to submit documents to prove their financial stability, business activity, and efforts to hire Canadians first.

Pay the fee: A processing fee is required for the LMIA application.

LMIA assessment: Service Canada will assess the application to ensure the employer has a genuine business need and that hiring a foreign national won't negatively impact the Canadian labour market.
