CONDITIONS:

Spain will begin a large-scale immigrant regularization process this Thursday (April 16), allowing hundreds of thousands of undocumented migrants to apply for legal residence and work permits.

To qualify, applicants must have lived in Spain since before January 1, 2026, stayed at least five continuous months, and have no criminal record.

A key change is that a sworn statement is no longer enough to prove the absence of criminal records. Instead, applicants must provide an official certificate from their country of origin. If they cannot obtain it, the Spanish government will try to request it through diplomatic channels.

Applications can be submitted online from Thursday and in person starting April 20, with a deadline of June 30.

🚨 Breaking: Final Text of Spain’s Mass Regularization Approved Today

Our Spanish lawyers have just obtained the final version of the mass regularization measure that will be approved today.

The government has created two main groups, depending on whether the person has applied for international protection (asylum) or not.

👉 Application period: until June 30
👉 Permit duration: 1 year (for both groups)

🟢 Group 1: Asylum Seekers (International Protection Applicants)

This applies to foreign nationals who, before January 1, 2026, had already submitted or formalized an asylum application in Spain.

✅ Requirements (all must be met):
• Be over 18
• Not currently in another residence/stay process (e.g. students are excluded)
• Not having had temporary protection for Ukraine
• Provide a passport (valid or expired — major advantage)
• Prove 5 months of residence in Spain before applying
• No criminal record (or must be cleared)
• No entry ban or return prohibition
• Pay the administrative fee

⭐ Key Advantage:

❗ No need to prove:
• Employment
• Family ties
• Vulnerability

👉 Just meeting the above requirements + having applied for asylum is enough.

⚠️ Important obligation:

After approval, the person must:
• Withdraw their asylum application (or appeal) within 1 month
• Apply for the residence card with proof of withdrawal

🔵 Group 2: Non-Asylum Applicants (“Extraordinary Rooting”)

This applies to people who:
• Were in Spain before January 1, 2026
• Have not applied for asylum

✅ General requirements:

Same as Group 1:
• Passport (even expired)
• 5 months of stay in Spain
• No criminal record
• No entry ban or return prohibition
• Over 18

⚠️ Key difference:

You must meet at least ONE of these 3 conditions:

1. 💼 Employment
• Have worked in Spain
• OR provide a job pre-contract
• OR declare intention to be self-employed
• Contracts must total more than 90 days in one year

2. 👨‍👩‍👧 Family Unit
Living in Spain with:
• Minor children
• Adult children with disabilities
• Or first-degree ascendants (parents)

3. 🆘 Vulnerability
• Proven by a report from:
• Local social services
• OR an NGO

⚖️ Common Effects for Both Groups
• From the moment the application process starts:
✅ You are temporarily allowed to live and work (employed or self-employed)
• If denied → this authorization is automatically lost

📄 Criminal Record Certificate

You must provide:
• Criminal record certificate from your country of origin
• And from countries where you lived in the last 5 years

👉 If difficult to obtain:
• You can prove you requested it
• Spain may obtain it via diplomatic channels
• The process can be suspended for up to 3 months

🔄 After 1 Year
• The residence can be:
• Renewed, or
• Modified
• Even without a job, renewal may be possible with active job search proof
