Here is exactly what you need to know about the penalties, documentation, and digital submission process to successfully transfer a worker under these conditions.

Visa Status & Fines

The financial implications of this transfer depend entirely on the validity of the worker's final exit visa at the time of the status correction request.

Expired Final Exit Visa: If the visa has expired (typically 60 days after issuance), the process incurs a 1,000 SAR Jawazat penalty fee for failing to depart the Kingdom within the specified timeframe.

Valid Final Exit Visa: If the transfer is initiated while the visa is still valid, no penalty fees apply. However, the administrative steps for the status correction remain exactly the same.

Required Documents

To initiate the transfer, the new employer must prepare a precise set of documents to prove mutual consent and legal compliance. Gathering these efficiently is crucial for a smooth process:

Employer Declaration: A formal letter drafted by the new employer requesting the status correction. This letter must explicitly state that the new establishment undertakes the payment of all government fees associated with the transfer. It must be officially attested by the Chamber of Commerce.

Worker Declaration: A written statement from the employee confirming their consent to the transfer and status change. This document must be physically stamped with the worker's fingerprint.

Iqama Copy: A clear copy of the worker's residency permit, regardless of whether it is currently valid or expired.

Employment Contract: The official draft contract generated and authenticated by the new employer through the Qiwa platform.

Once the documentation is complete, the process moves to the HRSD digital portals.

Where to Submit: The new employer must upload all compiled documents through the HRSD online platform. This is specifically done by navigating through the Virtual Appointment system and selecting the Labor Relations path for status correction.

Processing Time: After a successful submission of all verified documents, the status correction is typically completed by the Ministry within 5 working days.
