How can I stay in Sweden if I no longer meet the work permit threshold?

The new salary threshold means that a lot of people in Sweden on work permits no longer qualify under the new rules. What other permits are there for people who want to stay in the country?

1. LIVING WITH A PARTNER OF FAMILY MEMBER

You can get a residence permit to move to a family member in Sweden (also unofficially known as a sambo permit). This most commonly means a permit to live with a partner or spouse or a child aged under 18, but in exceptional circumstances may include other family members.

You can also apply for one of these permits if you’re planning to marry or become cohabiting partners with someone in Sweden, although you might need to explain to the Migration Agency why you weren’t already living together.

The family member you’re moving to doesn’t have to be a Swedish citizen, but they do need either permanent residency or a temporary residence permit as a refugee or person in need of subsidiary protection.

You will need documents proving your relationship. The exact documents you need vary, depending on what kind of relationship it is. For couples, it might include a marriage certificate or copies of rental contracts proving you have previously lived together. If you haven't previously lived together, you must also attend an interview.

The person you are going to be living with also needs to prove that they can support you by having suitable accommodation and a large enough salary to support you both. This is the case regardless of any income or assets you as the permit applicant have.

How long will it take?
As of November 2023, 75 percent of applicants moving to a partner received a decision within 18 months. Factors such as which family member you are moving to, how well you can prove your relationship (including documents showing you have lived together), which country you are from and what your family member's residence status in Sweden is may all affect the processing time.

Can I stay in Sweden while I wait?

You can’t usually apply for this kind of residence permit if you’re already in Sweden, but there are exceptions to this rule - such as for people already living in Sweden with a valid residence permit, including a work permit.

"As a general rule, an applicant for a residence permit to move to someone in Sweden needs to apply for this from outside Sweden, although there are some exceptions which mean it's possible to apply despite already being in Sweden," Migration Agency press spokesperson Vera Björk told The Local.

"If you have a work permit, the Migration Agency will make an individual decision as to whether there are reasons why you should be able to get a new permit without leaving Sweden. We will, among other things, look at how long you have lived in Sweden and whether you've had multiple temporary residence permits."

You should also be able to work in Sweden while you wait for your new permit to be approved, although again there are exceptions.

"If you've had a work permit for at least six months you have the right to keep working in Sweden while the Migration Agency processes your application," Björk said.

"When we process an application for a change of status - changing from a work permit to a permit to join a family member, in this case - the applicant must for example be able to show that they have fulfilled the requirements of the previous work permit."

2. GETTING A WORK PERMIT FOR ANOTHER JOB

If it doesn’t look like your current employer will be able to offer you a salary above the threshold, you may be lucky enough to find another employer in Sweden who can.

This may be a bit of a longshot depending on your industry and job role, but could be easier if your current salary is only slightly below the threshold.

If you already have a work permit in Sweden, then it is tied to that specific role at that specific employer for the first 24 months, meaning that you’ll need to apply for a completely new work permit if you change role or employer during this period.

After the first 24 months the rules are slightly different. If you change employer but stay in the same role, you don’t need to reapply for a work permit, but if you change role then you’ll need to apply for a new permit. Be aware that if you apply for a new work permit, even if you’re already working in Sweden, you will need to meet the rules at the time you apply for the new permit, rather than the rules you had on your old permit.

This means that you’ll need to meet the new salary requirement, as well as other requirements for employee insurance and maintenance for family members, as well as paying for a new permit application, which costs around 2,000 kronor depending on the industry. Can I stay in Sweden while I wait?

Yes, as long as you apply for your new work permit while your old one is still valid. You can also start working at your new job while you wait for your permit to be processed.

How long will it take?

As of November 2023, 75 percent of employees who applied online received a response on their application within 15 months. Factors such as which industry you will be working in, whether or not the employer is certified with the Migration Agency, and whether or not the application included all the necessary information all affect the processing time.

3. STUDYING IN SWEDEN

Another option, if you were planning on studying in Sweden at some point anyway, is to apply for a permit to study in Sweden.

You’ll need a place on a course of study in Sweden, at a university, university college, higher vocational education or at a folk high school at the post-secondary level, which means you need to apply and be accepted.

Be aware that there are earlier deadlines for international students than for those in Sweden, in order to give you time to get your paperwork sorted.

As well as proof of your place to study, you need to have paid the tuition fees - you’ll be considered an international student - and have proof that you can support yourself during your studies, as well as proof of health insurance.

If you are granted a study permit, you can work in Sweden while your permit is valid without also needing a work permit (although you are of course expected to study full time) in order to support yourself.

You’ll also have to apply for permits for any family members who will be living with you in Sweden while you study, as long as you can provide proof of their identity and that you have sufficient funds to support yourselves. Find out more about applying for a student permit here.

Swedish Migration Agency is preparing for higher subsistence requirements for workers from countries outside of the EU.

The subsistence requirement for labor immigrants will soon be raised, from today's SEK 13,000 to SEK 27,360. The government's aim is for the new requirement to apply from 1 November, 2023.

-We estimate that around 10-20 percent of those who apply for a work permit do not meet the new wage requirement and will be directly affected, says Anna Lindblad, deputy head of law at the Swedish Migration Agency.
The government has proposed to raise the income requirement for those who apply for a work permit in Sweden. Today, the requirement is that you must earn SEK 13,000 a month. From November 1, when the change is proposed to come into effect, you must have a salary of at least SEK 27,360. The sum, which is considered to be a good livelihood for a labor immigrant, is based on the fact that it is 80 percent of the median salary that Statistics Norway (SCB) publishes for Sweden every year. The amount changes annually.

- We are working on preparations for the new requirement to come into effect. We are looking at how the change in law will be applied and how different groups will be affected, says Anna Lindblad, deputy head of law at the Swedish Migration Agency.
The new requirement applies regardless of whether it is part-time or full-time employment. The salary must also be at the level of the collective agreement or practice within the profession or industry, but at least SEK 27,360.

The most recently published median salary at the time of application shall apply to the examination. It is therefore the time of application that will govern which median salary is to be applied.
Extension of permit.
Even when applying for an extended work permit, the Migration Agency must check whether the requirement for a good livelihood is met.
This applies both if the requirement will be met in the future and if the requirement was met during the previous permit period.

Facts: New income requirement
1. Occupations that are affected:
The professional areas that will be mainly affected by the increased supply requirement are service, care, sales, agriculture, gardening, forestry, berry picking, fishing and professions with requirements for shorter training or introduction. These groups usually have a salary that is below the new subsistence requirement.

2. Few exempted groups that are not affected by the new maintenance requirement:
Workers who are exempt from the new requirement are those who use free movement (citizens within the EU/EEA or are family members of a person who is), those who have or apply for an EU blue card, those who have or apply for an ICT permit , as well as seasonal workers.
Professional coaches and athletes, au pairs, interns within the framework of international exchange or interns with internships related to higher education and researchers will not be covered by the new requirement.

3. NO transition rules is going to apply
The new maintenance requirement comes into effect on November 1,2023 without transitional rules. This means that everyone who applies for a work permit must have a job that meets the requirement of good livelihood in order for a work permit to be granted. This also applies to applications for license extensions.

The intro­duc­tion of the new work permit model is star­ting in Sweden.

The report to promote highly qualified labour immigration has been submitted to the Government – and now the work of introducing the new model begins.

“We’ve been working on our mandate to implement a new model for work permits, which will make it easier to recruit foreign workers to Sweden, throughout the past year. Now we’re zeroing in on all parts of our organisation to make the transition as predictable and easy as possible for all parties,” says the Swedish Migration Agency’s Fredrik Bengtsson, Regional Director for Region South Sweden.

In the budget and policy specification for 2023, the Swedish Migration Agency received a mandate to promote highly qualified labour immigration to Sweden. The aim is to ensure that employers in highly qualified professional sectors get the labour they need, when they need it, thereby contributing to a competitive Sweden. In order to fulfil this task and to overhaul the entire work permit process, the Swedish Migration Agency has decided to introduce a new model for handling work permit cases and to establish international recruitment units.

The new model puts particular focus on:

1. Better service

2. 30-day processing time for a complete application

3. Easier to apply

“We’re going to have special service teams that will support companies and employers in the establishment of larger companies. We’re well aware that employers, especially in major expansion and establishment phases, have a broad need for labour from third countries. Through our strengthened service organisation, we will come together and work closely with those employers,” says Fredrik Bengtsson.

In cooperation with the employer organisations, the Swedish Migration Agency is also developing an improved e-service.

“It should be easy to apply for a work permit. The processing needs to be predictable and transparent. Our goal is to develop the e-service and the application procedure, thus increasing the proportion of complete applications.”

New model in place at the turn of the year 2023/​​2024
With the changes in the work permit process, the Swedish Migration Agency has committed to a 30-day processing time for highly qualified workers.

“A processing time of 30 days is in line with an international comparison of how long similar permit processes take in other countries. We anticipate that we’ll be ready to launch the entire model at the beginning of next year,” says Fredrik Bengtsson.

Sweden Plans to Tighten Requirements for Obtaining Citizenship.

Swedish citizenship marks membership in Swedish society and has a very high value, both legally and symbolically.

Through a press release published by the Ministry of Justice, the Minister of Migration( Maria Malmer Stenergard) said that by tightening the requirements for acquiring citizenship, the value of citizenship is also increased.

She stressed that the investigation is an important part of the government’s work to strengthen Swedish citizenship, adding that such changes are also important to promote integration.

According to the recent changes, the investigator must, among others:

1. Propose a requirement for longer residence in the country, in order to acquire citizenship.

2. Propose what additional knowledge regarding Swedish society and culture should be needed to require citizenship.

3. Propose a requirement of self-sufficiency and honest living in order to benefit from Swedish citizenship.
“It is not part of the investigator’s mandate to submit proposals for constitutional amendments. The assignment must be reported no later than September 30, 2024,” the statement reads.

4. In addition, the government of Sweden proposed increasing the period of time one must be a permanent resident in this territory before being eligible to apply for citizenship from the current four to five years to a minimum of 8 years.

The Minister of migration further stated that these are reasonable requirements that would contribute to a better integration.

Once the new changes become effective, Sweden will no longer be considered among the easiest countries for acquiring citizenship. In contrast, it will rank among the countries which apply strict rules for foreigners when it comes to this process.

The minister said that they’re not looking for superhumans, but this is about bringing Sweden in line with the requirements applied in many other countries, stressing that the recent changes will give the country a higher value over time, thus helping internationals to integrate.

At present, in order to acquire citizenship in Sweden, persons should be at the age of 18, be eligible to verify their identity, be able to support themselves, meet habitual residence requirements, have lived an ordered life in this country and have a permanent residence permit or the right of residence ( for EU citizens).
