🌍 Thinking about coming to America? 🇺🇸 Confused about Visas? 🤔 You're not alone!
With recent changes to some visa programs, it's more important than ever to know your options. Don't get lost in the paperwork! We've broken down some of the most common U.S. visas with simple examples to help you understand what might be the best path for you.
✅️ Are You a Star in Your Field? 🌟 (O-1 & EB-1 Visas)
These are for individuals with extraordinary ability or achievement in the sciences, arts, education, business, or athletics.
* Requirements: You must demonstrate sustained national or international acclaim in your field, often by meeting at least 3 of 10 USCIS criteria (e.g., major awards, high salary, published material about your work). An employer is not required for the EB-1A.
* Fees:
* O-1: I-129 petition filing fee is $1,055 (for large employers, less for smaller ones). A new, non-waivable $250 "visa integrity fee" applies.
* EB-1: I-140 petition fee is $715. There is also an Asylum Program Fee of up to $600.
* Optional: Premium processing for both costs an additional $2,805 for a 15-day decision.
✅️ Got a Business or Big Investment? 💰 (E-2, EB-5, L-1 & Gold Card)
Entrepreneurs and investors, this is for you! Bring your skills and capital to the American market.
* E-2 Visa (Investor - Temporary)
* Requirements: You must be a national of a treaty country and make a "substantial" investment in a U.S. business that you will direct and develop. There is no official minimum, but it is typically at least $100,000. The business cannot be "marginal" and must generate a profit beyond what is needed to support you.
* Fees: I-129 petition fee is $1,015. The visa application fee is $315.
* EB-5 Visa (Investor - Green Card!)
* Requirements: Invest $800,000 in a Targeted Employment Area (high-unemployment or rural area) or $1.05 million in a non-TEA. The investment must create at least 10 full-time jobs for U.S. workers.
* Fees: The main petition fee (Form I-526) is $11,160. There's a $1,000 Integrity Fund fee and other costs for adjustment of status and biometrics, which can add thousands more.
* L-1 Visa (Intra-Company Transfer)
* Requirements: You must have worked for a qualifying foreign company for at least one continuous year in the three years prior to filing and be transferring to a U.S. office in a managerial, executive, or specialized knowledge capacity.
* Fees: The I-129 petition filing fee is $695 (with a reduced rate for small employers). There is also a $500 Fraud Prevention and Detection Fee and a $300 Asylum Program Fee.
* "Gold Card" (Expedited Residency)
* Requirements: This new program offers a streamlined path to residency for individuals or corporations who make a significant financial contribution to the U.S. Treasury.
* Fees: The cost is a $1 million contribution for individuals or $2 million for corporations. There's also a separate, rigorous vetting fee of $15,000.
✅️ Looking for Specific Work Opportunities? 🛠️ (H-2A & H-1B Visas)
These visas cover various temporary work needs across different sectors.
* H-2A Visa (Agricultural Work - Temporary)
* Requirements: The employer must prove that there are not enough qualified U.S. workers for the temporary or seasonal agricultural work.
* Fees: Fees vary but include a $100 application fee and $10 per worker for the Labor Certification. There is also a $190 consular visa fee per worker that the employer must reimburse.
* H-1B Visa (Specialty Occupations - Temporary, Lottery-Based)
* Requirements: The job must require a bachelor's degree or its equivalent, and the applicant must have the required education. It's subject to an annual lottery.
* Fees: Employers must pay a $100,000 annual fee for each successful H-1B visa holder. This is a new, significant cost. Existing fees, which vary by employer size, can include the $215 lottery registration fee and a $780 I-129 filing fee.
