Under a state of emergency (SoE) in Trinidad and Tobago, certain rights of citizens can be suspended or limited as the government enforces measures to address the emergency. However, citizens retain some fundamental rights under the Constitution. Here’s a general breakdown:

1. Rights That May Be Restricted:
• Freedom of Movement: The government may impose curfews, restrict travel, and limit access to certain areas.
• Freedom of Assembly: Public gatherings and protests may be prohibited or restricted.
• Right to Privacy: Searches and seizures without a warrant may be allowed in specific circumstances.
• Freedom of Expression: Restrictions may be placed on media, public speeches, or social media to prevent the spread of misinformation or incitement.

2. Rights That Remain Protected:
• Right to Life: The state must still respect and protect the lives of its citizens.
• Protection from Torture and Inhumane Treatment: Citizens cannot be subjected to cruel or degrading treatment, even during an SoE.
• Fair Trial: If arrested or detained, individuals have the right to legal representation and a fair trial.
• Freedom of Religion: Citizens are generally allowed to practice their religion unless specific activities pose a threat to public safety.
• Right to Challenge Detention: Individuals detained during an SoE can file for habeas corpus to challenge the legality of their detention.
