Word needs to get out that the County Labs and the Government needs to be transparent with the people as innocent people can be convicted of crimes where the Government has not provided them with all the information or that their attorneys did not know of material information that may have led to the state having to drop the charges and to avoiding false convictions.
This is something I found out months ago while reviewing lab documents on a blood case where my client was charged with DUI Manslaughter. I noticed that the place where the Toxicologist’s name should be on the paperwork was missing. I did a Freedom of Information request and found out she was fired for falsification of evidence. This request was made in July 2019, and it still has not been fully completed. Until filed, no notice had been given to me by the state that she had been fired as required by the United States Supreme Court (Brady v. Maryland). Why?
I eventually notified the Public Defender’s office and I believe with their help and the Public’s awareness of this issue that we can get real answers to some very important questions. I also wonder why I wanted to see all files the Toxocologist worked on but was told it was too time consuming and near impossible to complete, but when word got out, suddenly they found twenty cases to review out of 200-250 that she worked on. What about the rest of the cases she worked on.
Something is wrong here and I will get to the bottom of this.
