False Accusations
False accusations are one of the surest ways to destroy another person’s reputation. When false accusations occur online they are all the more damaging, especially if friends, family and co-workers view them. When such false accusations are found online, there is usually no opportunity to offer another perspective. Unfortunately, online false accusations are often made by people unwilling to identify themselves. This type of attack can call one’s integrity into question – without offering any material proof.
Complaint sites, negative online reviews and mean spirited blogs that present false accusations quickly serve up the feeling of being violated online. There is little recourse available when the attacker does not identify him or herself. Conventional channels for dealing with false accusations do little good since the author’s identity is usually not validated, even if both parties know each other.
Many times when false accusations are first discovered, the natural inclination of the accused is to pursue action through the courts. While false accusations may be addressed through this channel, lacking a conclusive identity for your accuser the court system will be of little help. In fact, a great deal of money and time will probably be wasted when looking for such a resolution to address false accusations online.
False accusations are often nothing more than an offered opinion based on someone’s perspective. Opinions are protected by the First Amendment of the Constitution and they may not be challenged in court without material slander being present. When there is insufficient supporting evidence to determine whether an accusation is true or false, it is described as “unsubstantiated” or “unfounded.” Such false accusations can occur as the result of intentional lying on the part of the accuser or they may be unintentional. False accusations can arise spontaneously due to a momentary weakness in judgment or result from deliberate or accidental suggestive questioning or faulty interviewing techniques. While these circumstances offer a legal framework for ways in which to interpolate false accusations, this perspective offers little pragmatic comfort to the victim experiencing such false accusations.
Online false accusations also occur for businesses on a regular basis. While the origins for false accusations may be different, the end result is similar. False accusations can come in the form of customer review sites that allow anonymous reviews to direct false accusations at service, quality and price. False accusations many times take personal aim at the owners or employees of the business.
Companies also experience false accusations coming from slander sites. These blog based online platforms operate under the First Amendment and offer no protection for those accused. Many times such false accusations come from former employees or competitors. Potential customers see these false accusations online and assume they are accurate; seldom does someone call a company up and inquire about the truthfulness of online statements. By calling business practices, pricing or conduct into question these false accusations often materially damage the profitability of the business, yet without the opportunity to refute these false accusations most companies are not even aware of the business opportunities missed due to the inaccurate postings.
Another form of implied false accusation can come from simple images posted online. When casual images are posted impulsively from a smart phone there may be regrets at a later date. One might formulate a false accusation by simply drawing the wrong conclusion from an image. Party situations, beverages and conduct seen at the time as funny or humorous can create assumptions that are far from the truth. Unfortunately, when this happens it is very common to come to conclusions that amount to an unspoken false accusation.
