Letter of Escalation To Address Strong Arm Tactics By Nissan of Garden City Refusal To Reverse Contract Based on New York State Buyers Remorse Law
Dear Mr. Makoto Uchida & Mr. Jérémie Papin:
This letter of escalation addresses the Poor Customer Service & Strong Arm Treatment by Nissan of Garden City unwillingness to cancel the lease buyout of my used vehicle.
I am disgruntled by the fact that Nissan of Garden City is denying me my right to reverse the buyout deal after being notified within 12 hours after the transaction was processed. Under New York State Buyers Remorse Law, I’m allowed to change my mind without question to have a deal reversed or cancelled.
On November 12, 2020, I had the displeasure of experiencing the worst customer service in my sixteen (16) years of doing business with your Nissan and the Strong Arm Tactics used by Victor Diaz, Sales Manager of Nissan of Garden City, refusal to unravel my contract in order to profit off this deal rather than offering excellent customer service, experience & total quality management.
I entered a lease buyout of my used 2018 Nissan Pathfinder with Nissan of Garden City. The deal was facilitated and finalized by Salesperson, Mr. Maz Afghanzada. The terms and conditions were not explained to me
Nissan of Garden City did not include in my package Used Car Consumer Bill of Rights
On November 13, 2020, at approximately 9:00 am, less than 12 hours, I went back to Nissan of Garden City to cancel the buyout
I waited for more than 1½ hour before I could speak to someone about my cancellation
I was informed by the Sales Manager, Mr. Victor Diaz that the deal could not be undone and that my only option was to wait 45 to 90 days after the title for the 2018 Pathfinder is released
I was misinformed by Mr. Diaz and the Finance Officer, Mr. Desmond Bethune that this deal could not be unravelled because New York State allows for a 72 hour cancellation period when purchasing a used vehicle
I called Nissan Finance and was advised by Customer Service that cancellation was possible and all was need was the case number from Nissan of Garden City
The case number was requested from the Sales Manager, Mr. Diaz, who said @ Nissan of Garden City
