‼️A hearing on the Chiquita Lock removal is scheduled to begin this week, and those involved in the suit are encouraging the public to attend either in person or via Zoom.
At issue is whether the intention of the Florida Department of Environmental Protection (FLDEP) to issue a permit that would allow the City of Cape Coral to remove the lock is consistent with Florida statutes, the Clean Water Act and the Coastal Zone Management Act. (Specifically: chapter 373, Florida Statutes; Florida Administrative Code Chapter 62-330; section 401 of the Clean Water Act (401 U.S.C. § 1341); and section 307 of the Coastal Zone Management Act (16 U.S.C. § 1456)).
The petitioners fighting the Lock’s removal are Daniel Carney, James Collier and Kevin Sparks with support from a coalition that includes the Matlacha Civic Association (MCA), the Greater Pine Island Civic Association (GPICA), the Sanibel-Captiva Conservation Foundation (SCCF), the Calusa Waterkeeper and volunteers from the community.
The hearing, to be held before Administrative Law Judge Suzanne Van Wyk, is scheduled to take place from 9 a.m. to 5 p.m. Wednesday, Nov. 29, through Friday, Dec. 1 and then again from 9 a.m. to 5 p.m. Monday Dec. 4 through Thursday, Dec. 7.
