There is a myth online that E-2 applicants need to invest at least $100K in order to get an approved visa, but this simply isn't the case.

Instead of focusing on the investment total itself, ask yourself: "Is this investment substantial for the type of business I am opening?"

Many E-2 investors can invest much less than $100K and still prepare strong E-2 applications. The key point: focus less on the exact $, and more on proving that YOU have invested in everything you need to make your business operational.

Am 22. Mai 2026 veröffentlichte die USCIS ein Richtlinienmemo, in dem sie erklärte, dass "Adjustment of Status" Anträge – auch bekannt als I-485-Anträge – nur unter "außergewöhnlichen Umständen" genehmigt werden sollten.

Dies ist eine enorme Änderung gegenüber der aktuellen Richtlinie und weist die Beamten an, bei jedem Formular I-485 die Gesamtheit der Umstände zu bewerten, um sicherzustellen, dass die Genehmigung den Vereinigten Staaten zugutekommt, anstatt sie routinemäßig als Ersatz für das reguläre konsularische Verfahren zu behandeln.

Wir verfolgen diese Änderung um zu sehen, wie die USCIS diesen Standard anwendet und ob diese Richtlinie vor Gericht angefochten wird:

Für alle E-2 Antragsteller: hier gibt es hier ein kurzes Video zu den aktuellen Bearbeitungszeiten beim US-Konsulat in Frankfurt.

Kurz zusammengefasst: Plan lieber etwas mehr Zeit für die Bearbeitung beim Konsulat ein, da die Termine beim Konsulat im Sommer schnell ausgebucht sind.

Wie kann es schon Mitte Mai sein? 🙈 Das Jahr 2026 vergeht wie im Flug!

Wie immer gibt es hier einen kurzen Überblick über unsere Genehmigungen, die letzte Woche erteilt wurden. Ich freue mich über eine weitere EB-1-Genehmigung (diese sind im letzten Quartal besonders schwer zu bekommen gewesen) sowie über mehrere konsularische Genehmigungen von zwei deutschen Konsulaten.
